Use the advice and letter template from this website. Go to the home page then on right to How to Get Paid. It got MSNI to pay me the $125 they owed me for several months, when all of my other efforts failed. The constant faxing and emailing of this letter to them surely was the "squeaky wheel."

This situation is really frustrating because of the time involved in the priting docs, calling the borrower to confirm time and date for the closing, the time in the closing, calling the company to report a successful closing, and timely mailing the docs back. I guess I can chalk the $125 they owe me as a loss on my income tax for 2009. Did someone mention a class-action suit? Count me in....I just can't see the owner of this company getting a good night's sleep with all that he/she must have on their conscience.

Writing off the non-payment depends on your bookkeeping method, cash or accrual. You can only write it off as a loss if you've already claimed it as income (accrual method). If you use the cash method, as most of us do, and you count the income when it's received, not when the debt is incurred, you can't take the loss. In other words, you can't claim a loss on something you never had.

Can this be a class action, because they owe so many of us.

BEWARE OF SUNSET SIGNINGS LLC. This company does not pay its notaries for services performed. I completed a loan modification agreement for them on 1-7-10 and was told I would definitely be paid in spite of my concerns for non payment as posted by others on the notary forums. After numerous e-mails I finally received a check and it BOUNCED!! I have started legal action against Sunset Signing LLC. Work for them and you work for free.....
