We've all had that happen and the longer you've been in the game the better you are at spotting the 'signs'. Lightk is right; it's the Notary's responsibility so sometimes we have to suck it up (including paying out-of-pocket costs!) when there's an error or omission . If you're renting a car to do signings, you should be making doubly sure the docs are complete before you leave the signing. Crying babies and/or pesky pets are just part of the territory. We need patience, incredible organizational skills and the ability to stay focused so we can minimize the chance of getting one of those dreaded calls from the T.O. Those who can do that earn a reputation that results in those precious repeat calls from the signing companies.

If I make ANY mistake (note I said "I make" - not the phoney "missing document" story about the doc that they forgot to send) it's my TOP priority to fix it PRONTO.

That includes a return trip (of course at no charge) and FedEx - Priority Overnight using my account. If told that MY error is holding up a transaction - I would cancel (by asking permission to transfer to a trusted associate) any conflicting assignment. Then BEG the borrower to see me, ASAP, at their convenience - stressing the need for speed.

I would have checked the docs in the quiet serenity of the car, prior to going to the FedEx station.

There is more to being a “Notary Signing Agent” than just witnessing/notarizing signatures. Everything you mentioned is just part of the job. You made a mistake it is up to you to correct that mistake, at your cost. Anything else it totally unprofessional. Let’s just hope that if your house catches fire that the firefighters, are not too tired to come, or that it’s not too far to drive the fire truck, or that it will be inconvenient for them, or on a Saturday. If I were the hiring agency that you refused to correct your mistake with I would definitely be looking for someone more professional. JMO

No matter the distraction, it is the notary's responsibility to make sure the t's are crossed and the i's are dotted; signatures match the printed name exactly; etc... before leaving the signing table.

I know it's frustrating when all those things happen. And, at times it's all I can do to keep myself from throwing my embosser down and calling it quits.

Sometimes telling borrowers ahead of time that this signing should only take 45 minutes, that you have another signing scheduled back to back, and reminding them of the RTC and gentle reminders that you are sorry but you HAVE to leave at 6pm.

Then you could ask if they want to bring the baby in the room with you (at more than one signing, I've had babies or pets: dogs, cats, a lizard, birds and a ferret sitting in my lap or on my shoulder.) I've fed, burped and changed diapers so the borrowers could focus on the documents and sign as directed.

I wanted to preface that after I asked if they could use some other method of recovering the signature, I was instructed to go back at which time I told her I couldn't do it. I didn't just tell her no flat out. I thought the request was too demanding under the circumstances. It seemed the agency person wanted to punish me for the oversite.

So ocassionally I overlook a document being signed for whatever reason. It just slips through sometimes if the signing is continually interrupted with children such as babies needing to be attended to in the other room. In most all cases I take care of it on my end prior to it going back. However, this signing was different.

1. The agency cancelled this signing the previous day within a couple hours costing me a $8 Zip Car rental fee. I said nothing, nor did I complain. I've worked a lot with the agency. The appointment also caused me to turn down another assignment.

2. The next day I was reassigned the signing. I learned I had to drive out into the boonsies and pay extra for the Zip Car rental costing $30. I got lost on the way up and was very frustrated with the effort the signing was taking up to that point.

3. When I arrived, there was a small fold up table with tiny little chairs in a messy home of a Chinese couple. A child was in the room distracting and a baby was crying in the next room. Each time the baby cried, the man got up to attend to leaving for as much as 10 minutes. For the last few documents we waited for his return.

When I was at the FED EX ready to ship I checked through the docs and noted I somehow overlooked the Escrow Instructions signature. I had checked through the docs prior to leaving though casually. The very last doc to sign was missed due to the baby interruption.

I don't know is it my fault that the borrowers kept interrupting the flow of the signing with their baby attendance that caused this oversite? If not, at the very least why should I have to return for a non-notarized document rather than their addressing it through sign, fax back and FED EX on their own.

Why should I have to take any further loss over this lousy signing? I always attend to any oversites I make, but when the agency instructed me to GO BACK ON A SATURDAY that would cost me even more in Zip Car rental fees, not to mention my weekend I required rest, I said no. I told her no, and she came back very strongly with how disappointed with me she was.

I just couldn't go back for a one page document like this. I couldn't do it. You can have my client now who is probably looking for a new loan signing agent.
