Calculate what the actual recission date would be, inform the borrowers of the date and instruct them to contact their lender as soon as they are available about receiving a hard copy of one.

To make a VERY general statement - just about anything that's wrong with loan documents can be fixed, OTHER THAN THE NOTE.

If this loan required a rescission period and the RTC is missing - a rescission period can be provided to the borrowers quite legally, after signing but BEFORE funding.

Yes, definitely. We are knowledgeable about such things but only to give the TC or SS a heads-up. We cannot make that judgment call. We were hired to take the papers that were sent to us and get them signed. It's a double edge sword. We know it probably won't fly but if we don't go they will have come up with a solution but now we didn't follow through with the aptmt that we were scheduled to do. Myself, I would still go to the aptmt.

If there is no RTC in the package, the loan is for the same property the borrowers live in, a flyer explaining how to fill out the RTC is included in the package and no one from the signing service or lender is available, because it is the day after Thanksgiving, would you proceed with the signing anyway?
