I just called Express today for payment they owe me on a signing I did May 3. He said would get it out in the next few business days but looking at the comments here, makes me worry.

As I said - just be careful - do your corporate search and make sure you serve the right entity via the correct Agent for Service/Registered Rep...

Linda, you are awesome! No, I wasn't aware of the provisions that the State of Florida provides for, in relation to the proper venues in filing a suit in small claims court. The link that you also provided, makes that crystal clear. I am grateful that knowledgeable people, such as yourself, share that knowledge with others on this forum. Kudos to you, Linda!

Then you're aware that you don't need to file the small claims action in CA - you can file it right here in FL....per the FL Bar, in part (note especially #7):

"Right to Venue. The law gives the person or company who has sued you the right to file suit in any one of several places as listed below.... A proper location or venue may be one of the following:
1. Where the contract was entered into.
4. Where the event giving rise to the suit occurred.
7. In an action for money due, if there is no agreement as to where suit may be filed, where payment is to be made."

Just do your corporate research and make sure you sue the proper entity and serve them accordingly.

You have provided great advice. Yes, I have followed the acceptable demand proceedures. I am aware that I am able to start a small claims court action in CA even though I am here in Florida. However, my purpose of this post is to share with other notaries, and those who use mobile notary services, about my experience with Express Notary Inc and its' president Harry Couyoumjian, and prevent this from happening to them as well. It is definitly a time consuming process, that would be best to avoid.

Have you followed acceptable demand procedures? That is, sending them a written reminder, followed by a written demand, followed by a written demand that is sent certified mail/return receipt requested? Did you provide information upfront about payment, like when payment is due and that a 10% late payment fee would be applied? If you followed those procedures and documented everything, including invoicing dates and times, telephone calls, emails, etc., start small claims court action.

Express Notary Inc of 15145 Woodlawn Ave, Suite 150, Tustin, CA ordered 7 mobile notarizations in December of 2009 and as of June 1, 2010 has not paid for those notarizations which total $490 plus late fees of 10% monthly. This company, with Harry Couyoumjian as President of the company, has not responded to multiple requests for payment by fax or emails. A lot of money was spent on gas, paper, toner, etc., and the work was carried out precisely as he requested, but still no payment from Express Notary Inc., or its' President, Harry Couyoumjian.
