I'm not Carmen but I'll tell you the other SA who's telling you this is wrong - they're telling you it needs to be backdated and that's a no-no..the new notary cert is to be dated the date the signer signs in front of you and you notarize - today's date!! You are correct.

Now, two suggestions: (1) Let this other signing agent know that they are wrong and what they're advising you to do is illegal; and (2) Don't ask them for any advice again.

Hi Carmen,

Last week I have a client to sign a document called occupancy affidavit. Every thing was thought to be fine except I received a request to re-notarize the doc from the escrow office. The reason for that was the borrower made a wrong check mark on the occupancy (this is a purchase, the borrower marked on "We now occupy") and I overlooked it.

I was going to have the notarial date sign as of today's date, but another loan signing agent kept telling me that the notarial date needs remain the same date as of the date the loan doc was signed which was last week! I am confused because the borrower is here and he must sign on my journal as of today.. Am i right?
