How much risk should you put yourself through just to make a small notary and travel fee? I say none. The chance of ending up in court is not funny.

What if the signer is in a hospital bed. He can raise his right thumb to say yes. The family explains, "That's his way of saying yes". Wonderful! When you are in court for a fraud investigation, just tell that to the judge. Better yet, get a written statement from the alleged family about how that is how he says yes.

If you cannot communicate directly with the signer and get meaningful answers to your questions, don't notarize. If you have any question as to whether or not the signer understands the document, quiz them. If they fail the quiz, then go home without pay if necessary. That is better than being hijacked by the court system for a month. Right?
