Some title/escrow companies only pay if the loan funds, and most loans do fund. If the loan rescinds, the title company isn't paid and anyone working under the title company isn't paid either. If it's a long distance signing, I'm sure you could discuss payment with the company before accepting the assignment. If they say they can't pay if the loan rescinds, then you'll have a good idea of whether you'll accept the job or not.

You also might want to check the clerks office to see if the loan did record and who notarized the deed/mortgage. If it recorded and you're the notary then the escrow company owes you money.

Of course you do... You did your job and if it was done correctly you should be paid in full for your services. I flat out refused to do business with companies that either A) Don't pay or B) Pay less if a loan doesn't close do to no account of your own. Why should you pay the price for some closing/loan agent's incompetance? Or for a signer's cold feet?

Does your contract with them state the same? If so then you're probably have a much harder time getting your money back. If not then I would pursue it further towards getting whats owe to you.

In anycase thanks for sharing your story. I just got a phone call from this company and I'll make sure to block their number for the future.

Performed a signing for them in September and recently sent an email looking for payment. I got a one sentence response that read "File cancelled" with no further explanation. I assumed that they sent that to me in error so I responded that I believe they made an error. Here is what I got back "And I responded that this file is cancelled.
This is a refinance. No payment will be issued. Borrower cancelled." I then emailed for phone number where I could contact this person as they were obviously available since they were communication pretty readily by email and this is the response I received "Can you not read? My phone number is below. 714-378-9811." As I continued to be persistent in my efforts to get a response I then received this response "You can call tomorrow. I am the supervisor. This is my file. End of discussion."

I have yet to have anything like this happen to me and it did not state on their confirmation that I would not be paid for a loan that was rescinded. I drove an hour each way for this signing and I would not have taken that chance if I had known in advance that my fee could be in jeopardy.

I am curious if anyone else has any thoughts on the circumstance. Am I right to be upset for not getting paid on a file where the borrower rescinded. Should that information have been included in the confirmation. Any thoughts would be helpful.

Since there are so many Integrity ... companies out there here is the information for the company in question.
