Good to know that company is still trying to scam notaries and not pay them. Way to go Tom! You're a class act.

<<<lisa, i brought him with me because my husband was at work>>>

That's not the answer to the question I asked, but nonetheless, I don't believe you should be paid for this signing either. Others will disagree but so be it. If you couldn't get a babysitter, you should have given the job back and certainly not taken your son with you. You risked the hiring company's reputation and brought liability on the homeowner as your son was not an invited guest. JMHO

Did your babysitter cancel minutes before you were to leave for the appointment and you felt it was too late to call and give the job back? Just trying to understand your thoughts about why you took your child to the job....

tom,
your unprofessionalism shines like a bright light! how wonderful you must feel, throwing around allegations when you have no idea what you're talking about. 1) borrower's docs were wrong 2) you didn't even tell them that i was only a notary and could not change the mistakes made by their lender 3) borrower confirmed that he said nothing about my showing up with my son in "only a diaper". his complaint was that i showed up with him, period. it's awfully cute that you added the "really needed to be changed" but sadly, untrue. this is one of the flimsiest excuses i've heard of for a notary not to be paid. i'd love to see you in court tom, thanks for the invite!

i can see your point of view linda. point taken. the fact of the matter is, i did not bring my son to a closing with "only a diaper" on. i have contacted the BBB and they have referred me to several other agencies that can better suit my needs. tom is trying to get out of paying me. the actual fact is that the borrower's documents were incorrect. if his company had explained to the borrower that i was only there to witness their signatures, they could have taken care of the issues in the three days the borrower had to review their documents.

Curious why borrowers would cancel their loan due to a child's diaper...I'm not defending the practice of taking a child to a signing, which is evident by my post, but all due respect, e-mobile, that sounds rather silly and grasping at straws, IMO...

And, please don't post in all caps - it's difficult to read and comes across as yelling...thank you.:)

Hate to tell you this, but I doubt the BBB is going to help you with this. There are certain professional guidelines a company expects one to follow when conducting a signing for them - taking a child to a signing is definitely not on the list of allowable actions. I think it's pretty harsh not to pay you at all - if they feel that strongly about it they should pay you, maybe dock your pay for not following company protocol, chastise you and then remove you from their database.

Don't mean to sound nasty and if I do, I apologize, but this is on you - you should have known better. If you had a child care issue, you should have given your hiring party a heads up that you had to bring your son...they would have then had the opportunity to re-assign it.

Now, all this being said, I hope this isn't just their convenient way to get out of paying you. How did they find out about your son? Did the borrower complain?

Good Luck with this...

I did a signing for E-Mobile Notary in July 2005. I called numerous times...got run around a bunch. In the end - the only way I could get them to pay me was by taking them to small claims court. I was finally paid in OCTOBER 2005!! That's nuts! I'd be careful of them!
