Proof of Execution

Function: verb

A Proof of Execution is a notary act that is allowed in most states. Personal appearance of the signer is not required for this notarial act. It is necessary for the subscribing witness to be positively identified, generally with a government issued photo ID that has a physical description, serial number, and signature on it. Most notaries will never do this type of notarization in their entire commission or life. A special form or certificate with special verbiage is necessary to get a notarized document by means of a proof of execution.

Definition 1:
This notary act takes place when a subscribing witness or executing witness appears before a notary and swears that another particular person signed a document. This is the only notary act where someone can be notarized without appearing before a notary public.

Definition 2:
Please keep in mind that the procedure for Signing by X also requires a subscribing witness who watches the elderly person sign their X. However, in the Signing by X act, the subscribing witnesses must also help sign the signer's name. One witness signs the first name while the other signs the last name. The subscribing witnesses do NOT sign the person's name for a proof of execution under any circumstances, but merely witness the person signing.
