A New Jersey Notary can not "certify" any document.

Yes, I have....either it is requested that I certify something other than what a CA notary can certify OR a request for an impression of my seal on a non-ack or non-jurat page. I just explain to the customer what I'm able to do and line through wording, or include a sticky note so that it is apparent that I've seen the request but cannot follow through.

Just a question for any notaries in New Jersey or any notary that has had a similar experience.

Yesterday a couple came into my office with a Spousal Consent to Waive form from ING. The wife hands me the blank form and asked me to notarize it for her. I instructed her to first complete the form, sign, date, etc. Then I instructed the 'spouse' to read the section that pertained to him, sign and date. I also requested his identification. They both signed where indicated but I doubt that they read. Regarless, I compared his signature to the i.d. and picture. Once I started reading the notary section, which by the way said: CERTIFICATION BY NOTARY PUBLIC, I noticed that this section required me to certify that these two individuals were in fact husband/wife and the penalty for making a knowingly making a false statement was a fine of $10,000 in addition to federal charges levied against the me, the notary. I crossed out this section and instead stamped the back of the form with the correct ACK for California.

I would not sign this section because:
1) There is now way for me to know that these two individuals are husband/wife.
2) The 'husband' did not seem very serious about the entire process. He handed his wife a fake 'visa' card to pay for the service.
3) My job is to witness and authenticate signatures not marital status of individuals.

I was curious to know if anyone else out there has had any experiences with such a form from ING or any other firm asking you to 'certify'.
