Forms vary from state to state. Illinois also has an Acknowledgment in representative capacity which is similar in nature to what other states often call a Corporate Acknowledgment. The problem with a representative capacity being documented on a notarized form, is that it is often hard to know what the real position of an individual is, and what powers that position has to sign particular pieces of paperwork. The individual capacity Jurat form is fairly similar to other states. Remember that the affiant in a Jurat must sign the document in front of the notary and swear under oath that the contents of the document are true and correct. A notary public should keep pads of these forms in their office or vehicle, so they will be handy. Many notarized documents have certificate wording embeded in them. But, often, documents do not have certificate wording, so the notary must come prepared. The notary must never decide which type of notary form to use since that constitutes giving legal advice. The signer or document custodian is the one who must make this choice.
